Terms of use

Before using the program, please read the terms of the following license agreement. Any use of the program by you constitutes your full and unconditional acceptance of its terms. If you do not fully accept the terms of use, you may not use the program for any purpose.

Definitions

  • "Program" is the KNOWIKA app that will take your kids on an exciting learning journey using virtual teacher and parental controls to create a healthy balance between education and digital recreation!

  • "Rights Holder" the legal entity that owns the exclusive right to the Program under the relevant license agreement.

  • "User" means any person using the Program.

  • "Licensor" means acting on behalf of the Rights Holder.

1. General Provisions

1.1. This License Agreement ("License") sets forth the terms and conditions of use of the Program and is entered into between the User and the Licensor.

1.2. By installing the Program on a mobile device or using the Program in any way, the User expressly and unconditionally agrees to all terms and conditions of the License.

1.3. Use of the Program is permitted only under the terms of this License. If the User does not accept the terms of the License in full, the User may not use the Program for any purpose. Use of the Program in violation of (failure to comply with) any of the terms of the License is prohibited.

1.4. Use of the Program under the terms of this License is carried out on a reimbursable basis in accordance with the tariffs established by the Licensor in the territory of the User's location. Use of the Program on conditions and in ways not provided for by this License is possible only on the basis of a separate agreement with the Licensor.

2. Rights to the Program

2.1. The exclusive rights to the Program belong to the Rights Holder.

2.2. The non-exclusive right to use the Program is transferred by the Licensor to the User directly or through authorized persons by transferring individual electronic activation keys.

2.3. The use of individual electronic activation keys issued to another User is prohibited.

3. License

3.1. The Licensor grants the User the non-transferable right to use the Program on a compensatory basis, on the terms of a simple (non-exclusive) license, in the following ways:

3.1.1. Use the Program for its direct functional purpose by installing/playing it on the User's device(s).

4. Limitations

4.1. Except for use in the amounts and in the ways expressly provided for in this License, the User may not modify, decompile, disassemble, decrypt or perform any other actions with the object code of any Program, or make any other use of the Program without the written consent of the Licensor.

4.2. The User has no right to reproduce, distribute, or publicize the Program in any form and by any means not expressly provided for by this License, including together with other programs, as part of collections of software products, with the offer of other programs, settings, and other products, regardless of the purpose of such use, without the written consent of the Licensor.

4.3. The Program must be used under the name given by the Licensor. The User is not entitled to change the name of the Program, change and/or remove copyright notice, or any other copyright notice or indication of the Rights Holder.

5. Conditions of use of individual functions of the Program

5.1. User is hereby notified and agrees that when using the tutorials viewer feature, data will be requested from a third-party service.

5.2. The User is hereby notified and agrees that a permanent Internet connection is required for the Program to fully function and run.

5.3. The User is hereby notified and agrees that when using the Program, statistical and technical data on the use of the Program may be automatically transmitted to the Licensor. The User agrees that the transfer of this data to the Licensor is technologically necessary to ensure the correct operation of the Program. The Licensor undertakes not to transfer to third parties and not to use this data for any other purposes than to ensure the operability of the Program.

5.4. The User may at any time refuse to transmit the data specified in clause 5.3. by terminating the use of the Program.

6. Limitation of liability under the License

6.1. The Program is provided on an "as is" basis. The Licensor does not provide any warranties regarding the compliance of the Program with the User's specific goals and expectations, as well as does not provide any other warranties not expressly stated in this License.

6.2. To the maximum extent permitted by applicable law, the Licensor shall not be liable for any direct or indirect consequences of any use or inability to use the Programs and/or damage caused to the User and/or third parties as a result of any use or non-use of the Programs, including due to possible errors or failures in the operation of the Programs.

6.3. The Licensor may unilaterally, without notifying the Consumer, restrict access to the use of the Software in case of violation of the terms and conditions of this License Agreement.

7. Updates/new versions of the Program and third-party software

7.1. The Programs may from time to time automatically download and install updates that are intended to improve the Program and may take the form of patches, additional modules or completely new versions of the Program. The User is hereby notified of and agrees to the automatic updating of the Program, including requesting, downloading and installing Program updates on the User's computer without any further notice.

7.2. This License applies to all subsequent updates/new versions of the Program. Installing an update/new version of the Program means that the User accepts the terms of this License for the corresponding updates/new versions of the Program, unless the update/installation of a new version of the Program is accompanied by a different license agreement.

7.3. The Programs include third-party software as individual components.

8. Changes to the terms and conditions of this License

8.1. This license agreement may be changed by the Licensor unilaterally. The said changes in the terms and conditions of the license agreement shall come into force from the date of their publication unless otherwise stipulated in the relevant publication.

9. Data Privacy and Security

9.1. Your use of the Program is subject to the KNOWIKA Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Termination

10.1. This License will remain in effect until terminated by either party. The Licensor may terminate this License at any time upon written notice to the User for any reason or no reason at all. The User may terminate this License at any time by uninstalling the Program and deleting all copies of the Program from their device(s). Upon termination of this License, the User shall immediately cease all use of the Program and destroy all copies of the Program in their possession.
